DUI & DWI Penalties in Oklahoma City

Your legal consequences will vary depending on the circumstances of your alleged DUI incident. If there were minors in your vehicle and you obtain a prior criminal record, your punishments may be enhanced.

First offense – no passengers under 18

  • Misdemeanor
  • No less than ten days and no more than one year in jail
  • A fine of no greater than $1,000
  • A license suspension of 30 days
  • Required participation in an assessment and evaluation for treatment

First offense – at least one passenger under 18 (*child endangerment)

  • Felony
  • The jail sentence is extended to no greater than four years in prison
  • The maximum fine is $5,000

Second offense – no passengers under 18

  • Felony
  • No less than one and no greater than five years in jail or treatment and imprisonment
  • A License suspension of six months
  • A fine of no greater than $2,500
  • Required participation in an assessment and evaluation for treatment

Second offense – at least one passenger under 18 (*child endangerment)

  • Same as above except:
    • A separate jail sentence of no greater than four years is added
    • The maximum fine of $2,500 is increased to $5,000

Third offense (2nd Felony) – no passengers under 18

  • No less than one and no greater than 10 years in prison
  • A fine no greater than $5,000
  • An ignition interlock device is installed in the vehicle (vehicle won’t start unless driver passes a breathalyzer test)
  • 240 hours of community service
  • Required participation in an assessment and evaluation for treatment

Third offense

  • Range of 1-20 years in prison
  • A fine no greater than $4,500
  • An ignition interlock device is installed in the vehicle (vehicle won’t start unless driver passes a breathalyzer test)
  • 480 hours of community service
  • Required participation in an assessment and evaluation for treatment

Third/future offense/s – at least one passenger under 18 (*child endangerment)

  • Same as above except:
    • A separate prison sentence of no greater than four years is added
    • The maximum fine of $1,000 is increased to $5,000

*Child endangerment occurs if there is a child in the car when you are driving under the influence, which is a felony.
